Crago Atico International USA, Inc. 501 South Andrews Avenue Fort Lauderdale, FL 33301 RE: The tariff classification of a stackable wood wine bottle holder from China Dear Mr. Crago: In your letter dated May 15, 2008 you requested a tariff classification ruling. The ruling was requested on the “Do-It-Yourself Wine Holder, Item # A035FA00147.” An information sheet with a photograph of the product was submitted. The product consists of a hexagon shaped holder, made of pinewood, measuring 8-1/4” wide x 7” deep x 4-5/8” high. The holder is open on both ends and is designed to rest on its sides for the purpose of holding a wine bottle. The wine bottle holder may be stacked together with additional hexagon shaped holders in a variety of configurations. Each holder comes with three wooden pegs in the form of slats for fitting the holders together on three sides. The hexagon shaped holders are not specially designed to stand on the floor. The applicable subheading for the “Do-It-Yourself Wine Holder, Item # A035FA00147” will be 4420.90.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for wooden articles of furniture not falling within chapter 94. The rate of duty will be 3.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
