Dear Mr. Rizner: In your letter dated May 6, 2008, you requested a tariff classification ruling. As requested, your sample will be returned. Style 2499 “Pivot Bi-Color Sweatpant” is a pair of men’s pants constructed from 80% cotton, 20% polyester, finely knit fabric that is napped on the inside surface. The pants have a tunnel elastic waistband with an inside drawstring, side seam pockets, contrasting color self fabric inserts with piping on the side of each leg, and hemmed leg openings. Style 2499 will be imported in Men’s sizes XXS – 3XL. The applicable subheading for Style 2499 “Pivot Bi-Color Sweatpant” will be 6103.42.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’… trousers, …breeches and shorts (other than swimwear), knitted or crocheted: of cotton: trousers and breeches: … men’s. The rate of duty is 16.1% ad valorem. Duty rates are provided for your convenience and are subject to change. Style 2499 “Pivot Bi-Color Sweatpant” falls within textile category designation 347. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
