Dear Ms. Zhu: In your letter dated April 24, 2008, which was received in this office on May 13, 2008, you requested a tariff classification ruling. Your sample is being retained for our files. Style 382-3X6X “Men’s Super Size Tee” is a men’s T-shirt constructed from 100% cotton, jersey knit fabric that weighs 140 grams per square meter. The sample, in Navy Blue, has a rib knit crew neckline, short hemmed sleeves, and a straight hemmed bottom. The garment will be imported in two sizes, 3X6X and 7X10X, for use in government detention facilities. The garment measurements are consistent with men’s T-shirt specifications for these size ranges. Consequently, the applicable subheading for Style 382-3X6X “Men’s Super Size Tee” will be 6109.10.0012, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton: men’s or boys’: other T-shirts: men’s. The rate of duty is 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change. Style 382-3X6X “Men’s Super Size Tee” falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
