Dear Ms. Donoughue: In your correspondence, which was received by this office on April 28, 2008, you requested a tariff classification ruling on behalf of Jordache Limited. As requested, your sample will be returned. Style 6855 is a men’s cardigan constructed from 100% cotton, finely knit fabric that is napped on the inside surface. The fabric has an all-over printed design and measures 24 stitches per 2 centimeters counted in the horizontal direction. Style 6855 is cut and sewn and features a lined, self-fabric hood with a drawstring; a full front opening with a zippered closure; long sleeves with rib knit cuffs; an appliqué on the left chest; pouch pockets below the waist; and a loose fitting rib knit bottom. Although you refer to Style 6855 as a jacket, the loose fitting bottom does not provide protection against the elements as required for jackets. Consequently, the applicable subheading for Style 6855 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
