Dear Ms. Cumins: In your letter dated April 23, 2008 you requested a classification ruling on behalf of your client A.R. Knitwear Co., Inc. As requested, your sample is being returned to you. The submitted sample, style SX05JMM, is a woman’s dress that is constructed from 70% acrylic, 27% polyester, and 3% spandex jersey fabric. The size medium sample of style SX05JMM is a woman’s junior-sized dress that you have indicated corresponds to a size 7/9. The garment features a cowl collar, long sleeves, a self-fabric tie belt at the waist, and a straight bottom. The collar, sleeve endings, and garment bottom have a 2x2 ribbed knit fabric finish. The dress extends from the shoulders to above the knee area. The applicable subheading for the dress will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts ( other than swimwear ), knitted or crocheted: dresses: of synthetic fibers: other: women’s. The duty rate will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
