Dear Mr. Zelman: In your letter dated April 21, 2008, on behalf of Susana Monaco, Inc., 263 West 38 Street, New York, NY 10018, you requested a classification ruling. Your sample is being returned. The submitted sample, style b8c8315, is a woman’s double-breasted coat that extends to the thigh area and is worn over other garments for protection against the elements. The garment is constructed from 100% wool brushed knit fabric. The back panels and a portion of the front panels are lined with a 100% polyester woven fabric. The coat features a mock collar with 2 button closures, long cape-like sleeves, a full front opening with 3 functional buttons and 3 non-functional buttons, a self-fabric belt at the waist that threads through a self-fabric overlay on the back and has a 2 button front closure, and an unfinished bottom. The applicable subheading for the jacket will be 6102.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s overcoats, carcoats…and similar articles, knitted, other than those of heading 6104: of wool or fine animal hair. The duty rate will be 55.9 cents/kg + 16.4% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
