N025707 April 18, 2008 CLA-2-61:OT:RR:NC:3:359 CATEGORY: Classification TARIFF NO.: 6110.20.2079 Mr. Jeff Victoria Macy’s Merchandising Group 11 Penn Plaza New York, N.Y. 10001 RE: The tariff classification of woman’s pullover from Cambodia. Dear Mr. Victoria: In your letter dated April 2, 2008 you requested a classification ruling. As requested, your sample is being returned to you. The submitted sample, style 2552, is a woman’s “Style & Co. Sport” brand pullover designed to simulate a knitted pullover worn over a camisole. The cut and sewn garment is constructed from 100% cotton knitted fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a knit insert simulating a camisole at the v-shaped neckline, ¾ length hemmed sleeves, a drawstring hood, and a hemmed bottom. The submitted sample is a woman’s size 2X. Style 2552 would not be considered a shirt as the garment lacks an opening at the neckline with a closure. The drawstring tie functions as a tightening for the hood. The garment is properly classified as a pullover of 6110, HTSUS. The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
