N025424 April 22, 2008 CLA-2-61:OT:RR:NC:TA:359 CATEGORY: Classification TARIFF NO.: 6102.20.0010 Ms. Maya Kessler Eddie Bauer, Inc 10401 NE 8th Street, Ste 500 Bellevue, Washington 98004 RE: The tariff classification of a woman’s jacket from Cambodia. Ms. Kessler: In your letter dated March 25, 2008, you requested a classification ruling. Your sample is being returned as requested. The submitted sample, item #059-0730 (design reference #D3859626) is a woman’s jacket that is normally worn over other garments for warmth and protection from the elements. The jacket is constructed from 82% cotton, 18% polyester knit fabric that is brushed on the underside. The garment has a100% polyester Sherpa-like knit lining (except the sleeves). The garment features a drawstring hood that is also lined with the Sherpa-like fabric, long sleeves with ribbed cuffs, a full front opening with a zipper closure, 2 front vertical pockets with zipper closures, and a ribbed bottom. Side panels extending from under the arm to the ribbed bottom are constructed from ribbed fabric. The applicable subheading for the jacket will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s overcoats, carcoats…and similar articles, knitted, other than those of heading 6104: of cotton: women’s. The duty rate will be 15.9% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
