Dear Ms. Davidson: In your letter dated January 29, 2008, you requested a tariff classification ruling. Item number I063302GR is a metal storage container painted with coated powder. The container stands on the floor and is 78 inches high by 33 inches wide and 28 inches deep. There are two storage bins with 16 liter capacity each that swivel out for loading. The container can be used to recycle waste or for general office and household storage. The applicable subheading for the storage container will be 9403.20.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Other metal furniture, Other: Other.” The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
