The ruling was requested on an over-the-sink shelf, item # 10042003. Photographs of the product were submitted. The product consists of a wooden shelf, approximately 32” long, mounted on stainless steel collapsible legs. The shelf is designed to be placed over a kitchen sink to hold dish washing supplies or various other articles. In addition, the shelf also has steel side rails and hooks for hanging dish cloths and brushes. The over-the-sink shelf is a composite good composed of different materials, wood and steel. The essential character of the product is imparted by the wood because of the greater role the wood in plays in the functioning of the product as a shelf. The rate of duty will be 3.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
