Dear Ms. De Felice: In your letter dated February 27, 2008 you requested a tariff classification ruling. The sample will be returned to you. The submitted sample, style H3450 is a girl’s polo shirt. The garment is made of finely knit pique fabric that is 95% cotton, 5% spandex. The fabric contains at least 10 stitches per linear centimeter measured in the horizontal and vertical directions. The shirt has a collar, a two button placket opening that fastens right over left, short puff sleeves with rib knit fabric and a hemmed bottom with side slits. There is an appliqué and embroidery work depicting a ladybug on one side of the upper chest area. The shirt is a girls’ size 5. The applicable subheading for style H3450, will be 6106.10.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses and shirts, knitted or crocheted: of cotton: girls’ other. The rate of duty will be 19.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Girl’s cotton knit blouses and shirts fall within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
