Dear Ms.: In your letter dated February 11, 2008, you requested a tariff classification ruling. A sample of the item was submitted, examined and disposed of. The item, a flat box made of thin corrugated paperboard, measures 4-3/4” square and 9-3/4” high when assembled. The box has printed red and white brick work with two die-cut windows each with an awning. The box has a full flap closure on the bottom, a semi-open flap closure on the top, and a printed “Snack Shoppe” sign between the windows. It will be used for packaging candy, chocolates, crackers, etc. The applicable subheading for a paperboard box will be 4819.10.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for cartons, boxes and cases, of corrugated paper or paperboard, other than sanitary food and beverage containers. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
