Dear Ms. Braun: In your letter dated February 4, 2008, you requested a classification ruling. Your submitted sample, style SC235 is a girl’s top of velveteen knit 90% polyester,10% spandex fabric. The garment features long hemmed sleeves, a full front opening with a hook and eye closure and self-capping around the neckline, front opening and bottom of the garment. The garment does not reach the vicinity of the waist. The applicable subheading for style SC235 will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: of man-made fibers: tops, women’s or girls’. The duty rate will be 28.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
