The tariff classification of a woman’s blouse from Hong Kong
N021911 January 24, 2008 CLA-2-62:OT:RR:NC:TA:360 CATEGORY: Classification TARIFF NO.: 6211.49.1050 Ms. Maristella Iacobello Phillips Van Heusen Corporation 200 Madison Avenue New York, NY 10018 RE: The tariff classification of a woman’s blouse from Hong Kong Dear Ms. Iacobello: In your letter dated January 8, 2008, you requested a classification ruling. Your sample will be returned as requested. Submitted sample, style #9183, is a woman’s blouse constructed from knit and woven fabric. The upper part of the garment is constructed from 60% cotton, 25% nylon and 15% wool knit fabric. The lower part of the garment is constructed from 100% silk woven fabric. The pullover garment is collarless and features a square neckline, ¾ length sleeves, an empire waist and a hemmed bottom. Neither the knit nor the woven portion provides the essential character of the garment. Therefore, in accordance with General Rules of Interpretation, GRI 3(c), the garment shall be classified under the heading which occurs last in numerical order among those which equally merit consideration. In this case, the heading is 6211, HTS. The applicable subheading for the style 9183 will be 6211.49.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: containing 70 percent or more by weight of silk or silk waste: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The duty rate will be 1.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
