Malina Lands’ End, Inc. 2 Lands’ End Lane Location #22-290 Dodgeville, WI 53595 RE: The tariff classification of a woman’s singlet from Sri Lanka. Dear Ms. Malina: In your letter dated December 7, 2007 you requested a classification ruling. You have submitted a sample of a woman’s knitted 97% cotton, 3% spandex ribbed tank styled undershirt, style #179262 (also featured as style #191623 striped version) which is part of the “Lands’ End Intimates” line. It features a U-shaped neck and arm holes, as well as capping around the neckline and arm holes. You have also submitted marketing and advertising that demonstrates coordinating pieces such as briefs and panties, which are sold with this line. The applicable subheading for the undershirts will be 6109.10.0037, Harmonized Tariff Schedule of the United States (HTSUS), which provides for T-shirts, singlets, tank tops and similar articles, knitted or crocheted: of cotton: women’s or girls’: underwear. The duty rate will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
