Broad Street Philadelphia, PA 19112 RE: The tariff classification of an electric ceiling lighting fitting from China. Dear Mr. Hoffacker: In your letter dated December 5, 2007, you requested a tariff classification ruling on behalf of your client, Murray Feiss Import LLC. The merchandise under consideration is identified as the Satin Glass Fixture, article number RFM5108/2-18. This lighting fitting is a flush mounted ceiling light fixture which features a standard circular metal fitter and a glass mushroom-shaped shade/diffuser measuring approximately 6¾ inches high by 11½ inches in diameter at its widest point. The glass mushroom shade is clearly the predominate feature of this lighting fixture. The applicable subheading for the Satin Glass Fixture, article number RFM5108/2-18, will be 9405.10.8010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…: Chandeliers and other electric ceiling or wall lighting fittings…: Other: Household.” The general rate of duty will be 3.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
