Chivini Austin Chemical Company, Inc. 1565 Barclay Boulevard Buffalo Grove, Illinois 60089 RE: The tariff classification of tert-Butyl (R)-2-hydroxybutyrate, CAS No. 206996-51-2, imported in bulk form, from Italy Dear Mr. Chivini: In your letter dated November 29, 2007 you requested a tariff classification ruling. The subject product, tert-Butyl (R)l-2-hydroxybutyrate, is a nonaromatic carboxylic acid with an additional oxygen function (alcohol) indicated for use as a pharmaceutical intermediate. The applicable subheading for tert-Butyl (R)l-2-hydroxybutyrate will be 2918.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Carboxylic acids with alcohol function but without other oxygen function, their anhydrides, halides, peroxides, peroxyacids and their derivatives: Other: Other: Other. The rate of duty will be 4 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
