Dear Mr. Ponthieux: In your letter dated September 06, 2007 you requested a tariff classification ruling. The submitted sample, designated as style DJ042-1196.0, is an unbleached weft knit fabric of double knit construction that is composed of 50% polyester, 35% viscose rayon and 15% spandex. It is characterized by a jacquard knit design featuring a floral motif. This product is constructed using stuffing yarns that are inserted during the knitting process between the knit stitches of the top and bottom surfaces creating a fabric with a spongy consistency. Weighing approximately 230.6 g/m2, this item will be imported in 229 centimeter widths. Your correspondence indicates that this product will be used as mattress ticking. The applicable subheading for the weft knit mattress ticking fabric will be 6004.10.0085, Harmonized Tariff Schedule of the United States (HTSUS), which provides for knitted or crocheted fabrics of a width exceeding 30 cm, containing by weight 5 percent or more of elastomeric yarn or rubber thread, other than those of heading 6001, containing by weight 5 percent or more of elastomeric yarn but not containing rubber thread, other.
