Box 63639 935 Marine Drive North Vancouver, British Columbia Canada V7P 1S3 RE: The tariff classification of wine bottle bags from China Dear Mr. Hao: In your letter dated August 27, 2007, you requested a classification ruling. The samples which you submitted are being retained by this office. The sample identified as number 1 is a carrying bag specially fitted to contain one bottle. It is wholly made-up of non-woven polypropylene man-made textile material. It is unlined with one carrying strap and measures 4” (W) x 14” (H) x 4” (D). The sample identified as number 2 is a carrying bag specially fitted to contain two bottles. It also is wholly made-up of non-woven polypropylene man-made textile material. It is unlined with double carrying straps, and has a divided compartment. It measures approximately 8” (W) x 13” (H) x 4" (D). The applicable subheading for the wine bottle bags will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. HTSUS 4202.92.9026 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
