Shira Sharretts, Paley, Carter & Blauvelt, P.C. 75 Broad Street New York, NY 10004 RE: The tariff classification of a woman’s upper body garment from Sri Lanka Dear Ms. Shira: In your letter dated August 27, 2007, you requested a classification ruling on behalf of Ventura Enterprise Co. Inc. Your sample will be returned as requested. Submitted sample, style #221462S8, is a woman’s upper body garment constructed from 97% cotton and 3% spandex woven fabric. The abbreviated garment features a full front opening secured by two buttons, two pockets with flaps and the back has crisscross adjustable clip-on elasticized straps. The garment does not extend to the waist and provides insufficient coverage of the shoulders and upper back. The applicable subheading for the style 221462S8 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: other. The duty rate will be 8.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
