N014869 August 2, 2007 CLA-2-95:RR:NC:N2:225 CATEGORY: Classification TARIFF NO.: 9505.90.6000 Mr. Joseph Stinson Liss Global Inc. 7746 Dungan Road Philadelphia, PA. 19111 RE: The tariff classification of an “Easter floor standing chick assortment” (Liss Item # 975925) from China Dear Mr. Stinson: In your letter dated July 23, 2007, you requested a tariff classification ruling. You submitted a sample of the “Easter floor standing chick assortment” (Liss Item # 975925), which is being returned upon your request. The “Easter floor standing chick assortment” (Liss Item # 975925) measures approximately 24” in length x 12” in width and is mostly comprised of polyester. The item is a yellow and white floor standing chick that features a patch of white hair on its head, black pearl shaped eyes, an orange beak, defined arms and orange webbed feet. The chick is partially covered by a decorated Easter egg which is a recognized symbol of Easter. The decorated egg covers the chick’s stomach and has a pink background with decorated green, blue, and pink flowers. The chick will be imported in two styles (pink bow and red bow). The “Easter floor standing chick assortment” (Liss Item # 975925) will be used to decorate the home during the Easter holiday. The applicable subheading for the “Easter floor standing chick assortment” (Liss Item # 975925) will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
