N011899 June 7, 2007 CLA-2-29:RR:NC:2:238 CATEGORY: Classification TARIFF NO.: 2932.99.6100 Ms. Katherine Burns Camida Ltd Tower House New Quay, Clonmel Co Tipperary, Ireland RE: The tariff classification of Docetaxel Trihydrate (CAS -148408-66-6), imported in bulk form, from Taiwan Dear Ms. Burns: In your letter dated May 08, 2007, you requested a tariff classification ruling. The subject product, Docetaxel Trihydrate, is an antineoplastic drug, used mainly for the treatment of breast, ovarian, and non-small cell lung cancer. The applicable subheading for the Docetaxel Trihydrate, imported in bulk form, will be 2932.99.6100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with oxygen hetero-atom(s) only: Other: Other: Aromatic: Other: Products described in additional U.S. note 3 to section VI." Pursuant to General Note 13, HTSUS, the rate of duty will be free. This merchandise may be subject to the Federal Food, Drug, and Cosmetic Act and/or The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which are administered by the U.S. Food and Drug Administration (FDA).
