N011609 June 6, 2007 CLA-2-70:RR:NC:1:126 CATEGORY: Classification TARIFF NO.: 7013.99.5000 Ms. Trudi Van Heuvein Impact Innovations, Inc. 223 SE 1st Avenue Clara City, MN 56222 RE: The tariff classification of four decorative glass articles from China Dear Ms. Van Heuvein: In your letter dated May 11, 2007, you requested a tariff classification ruling regarding four styles of hanging glass ornaments, however only two representative samples (Design A - “Heart to Heart” and Design B - “Sealed with A Kiss”) were submitted with your ruling request. Design C - “Love” and Design D - “XOXO” (samples were not submitted). Each decorative glass article consists of the following motifs: Design A has two red hearts and the phrase “Heart to Heart”. Design B has red lips and the phrase “Sealed with a Kiss”. Design C has the word “Love”; the letters L. O. E. are pink and the V is symbolized by a red heart. Design D has red XOXO in capital letters. You state in your letter that all four glass articles are made of clear glass, not colored glass. Each style includes a ribbon hanger and a suction cup. Three of the glass articles (Design A, B, and C) measure 3.5 inches in width by 2.5 inches in height. Design D measures 2.75 inches in width by 3.75 inches in height. You indicate in your letter that the unit value of each glass article is over thirty cents but not over three dollars. The applicable subheading for the four hanging decorative glass articles will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes… other glassware: other: other: other: valued over thirty cents but not over three dollars each. The rate of duty will be 30 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
