Box 97000 Redmond, Washington 98073-9700 RE: The tariff classification of women’s sleep bottoms from Indonesia Dear Ms. Kessler: In your letter dated May 14, 2007, you requested a classification ruling. Your samples will be returned as requested. All of the submitted samples are women’s sleep bottoms constructed from 100% cotton woven fabric. Design numbers D3757512 (item number 057-0843) and D3757515 (item number 057-0842) feature an elasticized drawstring waist and long hemmed legs. Design number D3757520 (item number 057-0836) features an elasticized drawstring waist and Capri length legs with satin ribbon trim. You have indicated that these garments will be sold in the sleepwear department and are part of a mix and match sales concept. Based on their appearance and the manner in which they will be marketed, the garments are considered sleepwear. The applicable subheading for all styles will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
