N010765 May 23, 2007 CLA-2-70:RR:NC:1:126 CATEGORY: Classification TARIFF NO.: 7013.99.5000 Mr. Peter Salvato Import Commodity Group LTD 131 East Merrick Road Valley Stream, NY 11580 RE: The tariff classification of a decorative glass article from China Dear Mr. Salvato: In your letter dated May 2, 2007, on behalf of your client, Team Beans LLC, you requested a tariff classification ruling. A representative sample was submitted and will be returned to you as requested. The subject article, described as “Crystal Light Box” - style number P1260, is a decorative rectangular article composed of clear glass with beveled corners. The measurements are three inches in height by two inches in width. The product features an internal laser image/picture of a horseshoe. You state that the image contained in the glass article is made by engraving the inside of the glass with a laser. A battery-operated, light-up, mirrored stand measuring two inches in height by three inches in diameter is included with the glass article. The stand is illuminated by four LED (Light Emitting Diode) light bulbs. Batteries not included. You stated in a telephone conversation with this office that the unit value of the decorative glass article is over thirty cents but not over three dollars. The applicable subheading for the decorative glass article with light-up stand will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: other glassware: other: other: other: valued over $0.30 but not over $3 each. The rate of duty will be 30 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
