Coles CRI 2000, LP 2245 San Diego Ave. Suite 223 Sam Diego, CA 92110 RE: The tariff classification of photo albums from China. Dear Ms. Coles: In your letter dated April 24, 2007, you requested a tariff classification ruling. A sample identified as “Old Town bonded leather photo albums 2 pack” was examined and disposed of. The sample consists of two photo albums that are retail packed in a cardboard box and are shrink wrapped in clear plastic. Each album’s binder is leather bonded on wood (MDF), measures 13” long x 9-1/4” wide x 2-1/4” thick, and has three permanently secured plastic rods to accommodate three-holed paperboard pages. Each album has 54 double sided paperboard pages that measure 12-1/2” long x 8-1/2”. The title of the first page is “Photographs” and the title of the second page is “Index”. The lines under the titles provide room to make notations on the contents of the album. Pages 3 through 100 are for photos. A plastic partitioned photo sleeve accommodates three photos per page. Adjacent to the photo sleeve is a column with three groups of seven lines to notate captions for the three photos. Pages 103 through 108 accommodate two picture CD’s and a narrow center sleeve with the same caption lines for the photos. The applicable subheading for the photo albums will be 4820.50.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for albums for samples or for collections, of paper or paperboard. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
