Moynihan NorthStar Healthcare Limited 3300 Cork Airport Business Park Cork, Ireland RE: The tariff classification of Cefprozil (CAS-92665-29-7), Cephalexin (CAS-15686-71-2), Cefuroxime (CAS-55268-75-2), and Cefadroxil (CAS-66592-87-8), all imported in dosage form, from India Dear Mr. Moynihan: In your letter dated April 24, 2007, you requested a tariff classification ruling. Cephalexin and Cefadroxil are first-generation, semi-synthetic, cephalosporin antibiotics, while Cefprozil and Cefuroxime are second-generation, semi-synthetic, cephalosporin antibiotics. All four products are indicated for use as antibacterial drugs. The applicable subheading for Cephalexin, Cefadroxil, Cefprozol and Cefuroxime, imported in dosage form, will be 3004.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments…consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses (including those in the form of transdermal administration systems) or in forms or packings for retail sale: Containing other antibiotics: Other: Other." The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
