N009076 April 11, 2007 CLA-2-95:RR:NC:N2:225 CATEGORY: Classification TARIFF NO.: 9505.90.6000 Ms. Lindsey Beachy Limited Customs Services Two Limited Parkway Columbus, Ohio 43230 RE: The tariff classification of a Jack-O’-Lantern Glass Globe (Style #20046096) from China Dear Ms. Beachy: In your letter dated March 22, 2007, on behalf of Beauty Avenues, Inc., you requested a tariff classification ruling. You submitted a sample of the Jack-O’-Lantern Glass Globe (Style #20046096) which is being returned upon your request. The Jack-O’-Lantern Glass Globe (Style #20046096) is a water filled glass globe that features a three dimensional Jack-O’-Lantern inside. The Jack-O’-Lantern is decorated with bat designs and bat shaped glitter is blown around inside the globe by the internal fan mechanism when it is turned on to simulate flying bats. The internal fan mechanism is battery powered, the batteries are sold separately. There are two lights located inside the earthenware ceramic base that illuminate the orange and white strips on the black base when the battery operated mechanism is turned to on. The Jack-O’-Lantern Glass Globe (Style #20046096) measures approximately 6 ½” in height and 4 ½” in diameter. The Jack-O’-Lantern Glass Globe (Style #20046096) will be used to decorate the home to help create a scary environment for the Halloween holiday. The applicable subheading for the Jack-O’-Lantern Glass Globe (Style #20046096) will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
