Box 3165 Harrisburg, PA 17105 RE: The tariff classification of an electric garland from China. Dear Ms. Aldinger: In your letter dated February 6, 2007, you requested a tariff classification ruling. The submitted sample will be returned to you as requested. The merchandise under consideration is the Spider Web Light Set, item number 951461. It consists of a 5-foot black lead wire that continues into an electric miniature light set tied together in a manner that resembles a spider’s web. The other end of the lead wire terminates in a plug containing a built-in fuse. The web measures approximately 3.5 feet in diameter at its widest point, and features steady-burning purple miniature lightbulbs. Fastened to the center of the web is a purple plastic spider, which serves as a cover for a single purple bulb. This item can be used indoors or outdoors. The applicable subheading for the Spider Web Light Set, item number 951461, will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…: Other electric lamps and lighting fittings: Other.” The general rate of duty will be 3.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
