Adler, Import Department 7 West 34th Street New York, NY 10001 RE: The tariff classification of two tabletop decorations, from China and the Philippines Dear Ms. Osorio: In your letter dated December 21, 2006, you requested a tariff classification ruling. The two submitted samples are identified as the 10” Fabric Snowman Candy Holder (Item #C1404) and the 17” Pink Velour Topiary Cone Tabletop (Item #S3641). The decorated snowman measures approximately 10”H x 6”W x 5”D and features a sign that reads “LET IT SNOW.” You state that it is constructed of 80% rayon fabric, 10% paper, and 10% metal. The cone measures approximately 17”H x 3”W at its center. It is constructed of a paper form covered with textile fabric. The applicable subheading for the candy holder and the velour cone will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. The samples will be returned as requested. Duty rates are provided for your convenience and are subject to change.
