Dear Ms. Hu: In your letter dated December 10, 2006, you requested a classification ruling. As requested, the samples will be returned to you. You have submitted five samples. Style 9630 is a newsboy-style cap constructed of woven cotton fabric. The cap features a flat crown, snap visor, lining and a sweatband. Style 9631 is a newsboy-style cap constructed of woven cotton fabric. The cap features a flat crown, snap visor, lining and a sweatband. Style 9632 is a newsboy-style cap constructed of woven cotton fabric. The cap features a flat crown, snap visor, lining and a sweatband. Style 9634 is a Rex Harrison-style hat constructed of woven cotton fabric. The hat features a circular stitched snap brim, a sweatband, lining and self-fabric hatband. Style 9601 is a newsboy-style cap constructed of woven linen fabric. The cap features a flat crown, snap visor, lining and a sweatband. The applicable subheading for styles 9630, 9631, 9632 and 9634 will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether lined or trimmed: other: not knitted: … headwear of cotton, other. The duty rate will be 7.5 percent ad valorem. The applicable subheading for style 9601 will be 6505.90.2590, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether lined or trimmed: other: not knitted: … headwear of cotton, flax or both: other. The duty rate will be 7.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Styles 9630, 9631, 9632 and 9634 fall within textile category 359. Style 9601 falls within textile category 859. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
