Dear Ms. Haney: In your letter dated November 27, 2006 you requested a tariff classification ruling. The item is a mini dumper which is to be imported without an engine. This is a walk behind wheelbarrow and is designed to carry all types of materials on any terrain. It will be powered by a Honda engine that will be supplied and fitted in the United States. You will be importing the semi knockdown kit that will include all components except the engine. The applicable subheading for the mini dumper without engine will be 8704.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for motor vehicles for the transport of goods: Other. The rate of duty will be 25 percent. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
