Navidad Disguise, Inc. 11906 Tech Center Court Poway, CA 92064 RE: The tariff classification of costumes from China. Dear Ms. Navidad: In your letter dated November 15, 2006, you requested a tariff classification ruling. You submitted the following textile costumes, which meet the flimsy, non-durable requirements for classification within Chapter 95 and are being returned upon your request. Style 6497, Red Ranger Quality, is a textile costume set that consists of a red polyester jumpsuit, a mask and a belt buckle, with the jumpsuit imparting the essential character. Although the jumpsuit has styling (multiple layer belt), a well-made belt edge and a sewn-in second belt, it has a flimsy neck, waist and seams, a flimsy hook and loop closure and flimsy edges at the arms, ankles and closure. Style 6499, Black Ranger Quality, is a textile costume set that consists of a black and white polyester jumpsuit, a mask and a belt buckle, with the jumpsuit imparting the essential character. Although the jumpsuit has styling (multiple layer belt), a well-made belt edge and a sewn-in second belt, it has a flimsy neck, waist and seams, a flimsy hook and loop closure and flimsy edges at the arms, ankles and closure. Style 6551, Blue Ranger Quality, is a textile costume set that consists of a blue and white jumpsuit, a mask and a belt buckle, with the jumpsuit imparting the essential character. Although the jumpsuit has styling (multiple layer belt), a well-made belt edge and a sewn-in second belt, it has a flimsy neck, waist and seams, a flimsy hook and loop closure and flimsy edges at the arms, ankles and closure. Style 6553, Pink Ranger Quality, is a textile costume set that consists of a pink and white polyester jumpsuit, a mask and a belt buckle, with the jumpsuit imparting the essential character. Although the jumpsuit has styling (a multiple layer front), a well-made neck and two well-made belt embellishments, it has a flimsy waist and seams, a flimsy hook and loop tab closure and flimsy edges at the arms, ankles, closure and front styling feature. Style 6555, Special Ranger Quality, is a textile costume set that consists of a white, blue red, orange and black jumpsuit, with the jumpsuit imparting the essential character. Although the jumpsuit has styling (multiple layer belt), a well-made belt edge and a sewn-in second belt, it has a flimsy neck, waist and seams, a flimsy hook and loop closure and flimsy edges at the arms, ankles and closure. The applicable subheading for style 6497, Red Ranger Quality, style 6499, Black Ranger Quality, style 6551, Blue Ranger Quality, style 6553, Pink Ranger Quality, and style 6555, Special Ranger Quality, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.        Duty rates are provided for your convenience and are subject to change.
