N003592 December 5, 2006 CLA-2-:RR:NC:TA:359 NY CATEGORY: Classification TARIFF NO.: 6110.20.2079 Cliff Venable Hanesbrands Inc. – OS3D 1000B East Hanes Mill Road – 3rd Floor Winston-Salem, NC 27105 RE: The tariff classification of a women’s knit garment from United Arab Emirates Dear Mr. Venable: In your letter dated November 15, 2006 you requested a tariff classification ruling. We are returning your sample as per your request. The submitted sample was identified as style V9143, consisting of a women’s knit french terry jacket. Due to construction features, this garment is more accurately described as a cardigan. The cut and sewn cardigan is constructed from 96% cotton and 4% spandex knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the direction in which the stitches are formed. The garment features a full front opening with a zippered closure, kangaroo front pockets, long sleeves with rib cuffs, loose fitting ribbed bottom and a hood with drawcord. The applicable subheading for style V9143 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: Women’s: other. The rate of duty will be 16.5%. Style V9143 falls within textile category designation 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
