Dear Mr. Nagel: In your letter dated September 29, 2006, you requested a classification ruling for a woman’s shirt. The garment will be returned, as requested. Style 035X is a woman’s shirt constructed of 100% cotton knit pique fabric with more than ten stitches in both the horizontal and vertical directions. The shirt has a collar, a partial front opening with a four-button closure, short sleeves and a plain, hemmed bottom. The applicable subheading for style 035X will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s…shirts, knitted or crocheted: Of cotton. The rate of duty will be 19.7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The shirt falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
