Broad Street Philadelphia, PA 19112 RE: The tariff classification of three decorative glass articles from China Dear Mr. Hoffacker: In your letter dated August 29, 2006, on behalf of your client, Big Lots Stores, Inc., you requested a tariff classification ruling. Three representative samples were submitted and will be returned to you as requested. The submitted samples, designated in your letter as item number 839BL, are three decorative articles made of beveled mirror glass in the following shapes: round, square and octagon. The measurements are 4 ½ ” in diameter, 4 ½ “ square and 4 ½” across at its widest point, respectively. You stated in a telephone conversation with this office that each product would not be used as a mirror; rather, it will be used as a candle plate. You further stated that the unit value of each item in over $0.30 but not over $3.00. Although you describe these products as candle plates, they can be used to hold a variety of items. The applicable subheading for the three decorative glass articles will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: other glassware: other: other: other: valued over $0.30 but not over $3 each. The rate of duty will be 30 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
