NY M86513 October 4, 2006 CLA-2-42:RR:NC:N3:341 M86513 CATEGORY: Classification TARIFF NO.: 4202.32.2000 Thaddeus Gapinski Import Manager Port Brokers, Inc. 152-60 Rockaway Blvd. Jamaica, NY 11434 RE: The tariff classification of lottery ticket holders from China Dear Mr. Gapinski: In your undated letter that was received in this office on September 7, 2006, you requested a tariff classification ruling on behalf of your client, Vibration Sales Promotions, of New York City, NY. The submitted samples are identified as lottery ticket holders. Each is made of clear plastic sheeting and is designed and sized to hold lottery tickets. They measure approximately 9” x 4”. The lottery ticket holders bear the logos and promotional language of various state lotteries. In your ruling request, you recommended classification of the submitted items under Harmonized Tariff Schedule of the United States (HTSUS) 3923.29.0000. It is noted that the lottery ticket holders have features common to items of heading 4202 and are, therefore, more specifically provided for there. The applicable subheading for the lottery ticket holders will be 4202.32.2000, (HTSUS), which provides, in part, for articles of a kind normally carried in the pocket or in the handbag, with an outer surface of plastic sheeting, other. The rate of duty will be 20 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
