Manager American Cargo Express, Inc. 435 Division Street Elizabeth, NJ 07201 RE: The tariff classification shopping tote bags from Taiwan Dear Mr. Rivera: In your letter, which was received in this office on August 16, 2006, you requested a classification ruling. The request is on behalf of Winter Designs of New York, NY. The two submitted samples are not identified with style numbers. Both items are double handle shopping tote bags constructed with an outer surface of plastic sheeting. The first bag, which depicts a dinosaur, measures approximately 12” (H) x 15” (W) x 5” (D). The second bag, which is silver in color, measures approximately 11” (H) x 13” (W) x 3” (D). Both bags are suitable of repetitive reuse. The applicable subheading for the bags will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport and similar bags, with outer surface of textile materials or of sheeting of plastic, other. The duty rate will be 20 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
