Customs Compliance Department 1617 Sixth Ave., Suite 1000 Seattle, WA 98101-1742 RE: The tariff classification of a woman’s bolero jacket from China Dear Mr. Nelson: In your letter dated July 7, 2006, you requested a classification ruling. Your sample is being returned as requested. The submitted sample, style number NO115604, is a woman’s bolero jacket that is constructed from 100% cashmere, knit fabric. The garment has three panels that are sewn together lengthwise and it does not reach the waist. The jacket features long sleeves and a full front opening with a tie closure. You suggest that the garment be classified in heading 6108, Harmonized Tariff Schedule of the United States (HTSUS). However, the garment is more specifically provided for in heading 6104, HTSUS. The applicable subheading for the bolero jacket will be 6104.31.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s suit-type jackets, knitted: of wool or fine animal hair. The duty rate will be 54.8 cents/kg + 16% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The jacket falls within textile category designation 435.
