Dear Ms. Harwell: In your letter dated June 27, 2006, you requested a classification ruling. You have submitted four samples. Style 0100 Chef Hat is constructed of 65% polyester and 35% cotton woven fabric. The hat is adjustable with a hook and loop closure for a perfect fit. Style 0156C Beanie is a chef-type hat constructed of 100% cotton woven fabric. The hat features a flat crown, the band is approximately 3 ½ inches tall and has partially elasticized back. Style 0157C Kool Beanie with mesh is a chef-type hat with an approximately 3 ½ inches tall band constructed of 100% cotton woven fabric with a partially elasticized back. The flat top of the crown is constructed of 100% polyester knit mesh fabric. Neither the knit crown, classifiable under heading 6505.90.60, or the woven band, classifiable under heading 6505.9020, imparts the essential character to the Kool Beanie. Following General Rule of Interpretation (GRI) 3 (c), it will be classified under the heading which occurs last in numerical order in the HTS. Style 0155C Scull Cap is a chef type hat constructed of 100% cotton woven fabric. The hat is a scull type hat with self-fabric ties and a partially elasticized back. The applicable subheading for style 0100 will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for hats and headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed . . .: other: of man-made fibers: other: not in part of braid, other: other: other. The duty rate will be18.7 cents per kg. plus 6.8 percent ad valorem. The applicable subheading for styles 0156C and 0155C will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: other: of cotton, flax or both: not knitted: and headwear of cotton, other. The rate of duty will be and 7.5% ad valorem. The applicable subheading for style 0157C will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric. . . .: other: of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, other: other: other The duty rate will be 20 cents per kilogram plus 7 percent ad valorem.
