Dear Ms. Caliari: In your letter dated June 7, 2006, you requested a classification ruling. As requested, the sample will be returned to you. Your submitted sample, style 93066 is a Women’s “Maternity Knit Tummy Sleeve”. The item is constructed of 85% nylon and 15% spandex fabric tube. The clothing accessory measures approximately10 ½ -inches, is hemmed, and can be slipped over unbuttoned pants for a customized fit. If the pants are too loose the sleeve than can hold them on to the wearer’s body. The applicable subheading for style 93066 will be 6117.80.9540, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up clothing accessories, knitted or crocheted, knitted or crocheted parts of garments or clothing accessories: other, other accessories: other: other, of man-made fibers: other. The duty rate will be 14.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
