Dear Ms. Hu: In your letter dated June 15, 2006, you requested a classification ruling. The samples will be returned to you as requested. Five hat samples were submitted with your request, Styles 9019, 9737, 9310, 9311 and 9314. Style 9019 is a bomber-style hat constructed of woven 100% polyester fabric. It features a woven polyester fabric lined crown and faux fur fabric lined earflaps with a hook and loop chinstrap. Style 9737 is a bomber-style hat constructed of woven 100% wool fabric. It features a woven polyester fabric lined crown and faux fur fabric lined earflaps with a hook and loop chinstrap. Styles 9310, 9311 and 9314 are constructed of knit 100% polyester fabric and are lined with faux fur fabric. Style 9310 is a driving cap that features a sweatband. Style 9311 is a bomber-style hat that features earflaps with a self-fabric tie chin strap. Style 9314 is a bomber-style hat that features earflaps with a buckle chinstrap. The applicable subheading for the Style 9019 will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…whether or not lined or trimmed: other: of man-made fibers: other: not in part of braid, other: other: other. The rate of duty will be 18.7 cents per kilogram plus 6.8 percent ad valorem. The textile category designation is 659. The applicable subheading for Style 9737 will be 6505.90.4090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric… whether or not lined or trimmed: other: of wool: other, other: other. The duty rate will be 31 cents per kilogram plus 7.9 percent ad valorem. The textile category designation is 459. The applicable subheading for Styles 9310, 9311 and 9314 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…whether or not lined or trimmed: other: of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, other: other: other. The duty rate will be 20 cents per kilogram plus 7 percent ad valorem. The textile category designation is 659.
