Dear Mr. Wadiri: In your letter received on May 10, 2006, you requested a tariff classification ruling. The “Laser Snowman” candle consists of an electroplated 3-dimensional snowman shaped wax candle available in two sizes (Item # LOS1002 8”H and Item # LOS1001 4-3/8”H). The candle is said to contain 60% palm wax and 40% paraffin wax. The applicable subheading for the “Laser Snowman” candle will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
