NY M82540 April 21, 2006 CLA-2-61:RR:NC:TA:357 M82540 CATEGORY: Classification TARIFF NO.: 6113.00.9025 Redcats USA Ms. Jayne Uronis 463 Seventh Ave. New York, NY 10018 RE: The tariff classification of a men’s jacket from China Dear Ms. Uronis: In your letter dated April 10, 2006, you requested a classification ruling. A sample was submitted and is being returned as you requested. The item in question, style #40699, is a men’s upper-thigh length jacket with a shell made from a 100% polyester knitted fabric with a PU (polyurethane) coating on the outer surface. The garment has a full front opening with a zipper closure, a self-fabric hood, long sleeves with elastic and a hook and loop tab at the ends, patch pockets with flaps in the chest, double entry pockets at the waist with a zipper and a flap closure and a full taffeta lining. The coating on the outer surface of the fabric does not completely obscure the underlying fabric. The applicable subheading for the jacket will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907, other men’s or boys’ coats and jackets, other than of cotton. The duty rate will be 7.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
