Dear Ms. Parker: In your letter dated March 30, 2006, you requested a tariff classification ruling. As requested, your sample will be returned. Style 51002 “Men’s Form Fit EKG Tee”, is a men’s pullover garment constructed from 77% polyamide, 17% polyester, 6% spandex, finely knit patterned fabric that measures 34 stitches per two centimeters counted in the horizontal direction. There is a change in knit pattern on the upper portion of the front and rear panels, the shoulders, and decorative lines along each side that measures 30 stitches per two centimeters counted in the horizontal direction. Style 51002 fits close to the body and has a crew neckline; short, hemmed sleeves; and a straight, hemmed bottom. The applicable subheading for Style 51002 will be 6110.30.3053, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’. The rate of duty is 32 per cent ad valorem. Duty rates are provided for your convenience and are subject to change.
