Dear Ms. Bolan: In your letter dated March 22, 2006, you requested a classification ruling for a woman’s upper body garment. The submitted sample, Style #0804563, is a woman’s upper body garment constructed from 62% polyester, 33% rayon, and 5% spandex knit fabric. The garment features long sleeves, a full front opening with a tie closure at the waist, and a back that extends approximately 14 inches. The garment has shoulder coverage, but does not cover the bust. We are returning your sample as you requested. The applicable subheading for Style 0804563 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of man-made fibers, other, other, women’s or girls’. The rate of duty will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
