NY M81051 March 27, 2006 CLA-2-61:RR:NC:TA:359 M81051 CATEGORY: Classification TARIFF NO.: 6110.30.3057 Ms. Melissa Fox Barthco Trade Consultants The Navy Yard 5101 South Broad Street Philadelphia, PA 19112-1404 RE: The tariff classification of a woman’s pullover from China Dear Ms. Fox: In your letter dated March 8, 2006, on behalf of Jones Apparel Group, you requested a classification ruling. Your sample and components are being returned as requested. The submitted sample, style number VFPB93528, is a woman’s pullover that is constructed from 55% rayon, 45% nylon knit fabric. The outer surface of the garment measures more than 9 stitches but equal to or less than 18 stitches per 2 centimeters measured on the outer surface of the fabric in the direction in which the stitches were formed. This garment meets the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS). The garment features a V-neckline with a 3 button partial opening, cap sleeves with ribbed edges, and a self-start bottom. All the components are looped and linked to form the finished garment. The applicable subheading for the pullover will be 6110.30.3057, HTSUS, which provides for pullovers, knitted: of man made fibers: other…other: knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
