Hartill Capital Transportation Customs Clearance Services, Inc. 167-18 146th Avenue Jamaica, New York 11434 RE: The tariff classification of women’s shorts from China. Dear Mr. Hartill: In your letter dated March 6, 2006, you requested a classification ruling on behalf of Ballet Makers, Inc. Style TENDU is a women’s pull-on dance short constructed of two panels of 100% acrylic knit fabric with front and rear center seams. The garment features a rib knit finish at the waistline and short leg openings. An “ABT” embroidered label is found on the front lower right leg. The applicable subheading for Style TENDU will be 6104.63.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: Trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other . . . Shorts: Women’s. The rate of duty will be 28.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
