Seltzer Uti, United States, Inc. 2975 Kennedy Blvd. Jersey City, N.J. 07306 RE: The tariff classification of a woman’s pea coat from China Dear Mr. Seltzer: In your letter received in this office on February 3, 2006, on behalf of LL & S Purchasing Corporation, you requested a classification ruling. The sample submitted, style number 89707FFFWW, is a woman’s pea coat constructed of a shell composed of a woven 80% wool/20% Viscose fabric. The coat is lined with a woven 75% silk/25% nylon fabric. The coat extends to the thigh area in length, is slightly fitted at the waist and has a notched lapel-style collar with a double-breasted full front opening that is secured by a right-over-left, six-button closure. The coat has long hemmed sleeves and a straight cut hemmed bottom. The garment has two front slash pockets below the waist, a self-fabric belt segment on the rear portion of the waist. The silk blend side has a left chest pocket and two pockets below the waist that are trimmed with the wool/Viscose fabric. Although the garment has pockets on the reverse side and the front closure can be buttoned on each side, examination of the fabrication and finishing indicates that it is not suitable for wear with the silk/nylon fabric side exposed. As such, your suggested classification, 6202.99.1000, is not applicable. The applicable subheading for the coat will be 6202.11.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s overcoats, carcoats, capes, cloaks and similar coats: Of wool or fine animal hair. The duty rate will be 41¢/kg + 16.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
