Broad Street Philadelphia, PA 19112 RE: The tariff classification of a women’s upper body garment from Saipan and/or the Philippines. Dear Ms. Fox: In your letter dated January 24, 2006, you requested a classification ruling for women’s knit garments on behalf of Ann Taylor, Inc. The submitted sample will be returned to you, as requested. Style 200011 is a woman’s knit upper body garment, described as a shrug, constructed from 65 percent polyester, 35 percent cotton knit fabric. The garment has does not reach the waist, has a full front opening with no means of closure, ¾ length sleeves, and a hemmed bottom. When worn, the garment will provide insufficient coverage of the bust. The applicable subheading for this garment will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’. The duty rate will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
